These terms apply to every use of TrendScoutly, including free reports and paid plans, offered by [COMPANY NAME], registered with the Dutch Chamber of Commerce under number [KVK NUMBER] (“TrendScoutly”, “we”).
1. What we deliver
TrendScoutly delivers a weekly report about the competitors you choose and the products trending in your market, in your dashboard and as a PDF by email. The first report arrives within 24 hours after you have entered your business details and competitors, then every Monday. What each plan includes is described on our pricing page at the time you subscribe:
- Starter: 3 competitors, 1 market, top 5 trending products per week.
- Growth: 5 competitors, 1 market, top 10 trending products per week.
- Pro: 8 competitors, up to 3 markets, top 10 trending products per week with the reasons why, and priority email support (reply within 1 working day).
You can switch competitors in your dashboard: on Starter and Growth once a month, on Pro anytime.
2. Public data, no guarantee of completeness
Our reports are based on publicly available data from third-party platforms. We do our best to be accurate, but we cannot guarantee that the data is complete, correct or up to date, or that a platform keeps making it available. We do not provide, estimate or promise advertising budgets, revenue, view counts of ads or sales figures of other companies. Trending products are based on public signals, not on sales data. Reports are information, not advice; you decide what to do with them.
3. Free report
The free report is available once per company: once per account, per company website and per company email domain. We may check requests by hand and may refuse requests that appear to misuse the offer.
4. Prices, payment and invoices
Plans are billed monthly in advance in euros in Europe and in US dollars elsewhere, via our payment provider Stripe: Starter €149 / $169, Growth €299 / $349 and Pro €749 / $869 per month. All prices include tax. EU businesses with a valid VAT number: VAT is reverse-charged and shown on your invoice. Invoices are sent automatically. If a payment fails, Stripe will retry it; after 3 failed attempts (about 2 weeks) your plan is paused and reports stop until payment succeeds.
5. Upgrades, downgrades and cancellation
- An upgrade takes effect immediately; the difference is charged pro rata.
- A downgrade takes effect at the start of your next billing period.
- You can cancel at any time via “Manage subscription” in your dashboard. Your plan runs until the end of the paid month, after which reports stop.
6. Refunds
We do not refund a month that has started. If a report is not delivered because of an error on our side, that week is free.
7. Use of reports
Reports are for your own internal use. Screenshots of third-party ads, emails and websites in your reports may be protected by the rights of their owners; do not publish them or use them in your own marketing.
8. Liability
Our total liability for any claim is limited to the amount you paid for one month of your plan. We are not liable for indirect damage, such as lost profit or missed opportunities. This does not limit liability that cannot be limited by law.
9. Your account and data
Keep your login details safe. You can delete your account in your dashboard. After cancellation we keep your account and report history for 90 days in case you return, then delete it. See our Privacy Policy.
10. Changes
We may change these terms. We will email you about material changes in advance. If you do not agree, you can cancel before the change takes effect.
11. Governing law
These terms are governed by Dutch law. Disputes are submitted to the competent court in [CITY], the Netherlands, unless mandatory law says otherwise.
